Taking and Making a Statement: An exploratory study analysing through the lens of research the production of witness statements by lawyers and litigants in person (MAS)

MAS is funded by the Nuffield Foundation and runs from July 2019 to December 2020. The project examines how witness statements are prepared and produced for the Employment Tribunal. We will consider the rules and guidance on witness statements, psychological research on best practice for interviewing witnesses and conduct up to seventy-five interviews including with litigants in person and legal practitioners. We are seeking to highlight examples of good practice for achieving the best quality witness statements as well as areas for potential improvement. Project recommendations are likely to address support mechanisms for litigants in person and witness statement preparation more generally.

This work is due to be completed in December 2020.
